According to Article 5 of the Law of Ukraine "On Technical Regulations and Conformity Assessment", the Cabinet of Ministers of Ukraine resolves:

1. To approve the Technical Regulations low-voltage electrical equipment supplied.

2. The Ministry of Economic Development and Trade to ensure the implementation of this resolution approved by the Technical Regulations.

3. To establish that the provision in the market of low-voltage electrical equipment that meets the requirements of the Technical Regulations low-voltage electrical equipment approved by the Cabinet of Ministers of Ukraine dated 29 October 2009 r. Number 1149 (Official Bulletin of Ukraine, 2009., Number 83, p. 2822; 2012 r., number 66, p. 2702), and was put into circulation before the entry into force of the decree, can not be prohibited or restricted by reasons of non-compliance of such equipment with the requirements of the Technical regulation approved by this Resolution.

4. Make the Cabinet of Ministers of Ukraine changes that are added.

5. To declare invalid the decision of the Cabinet of Ministers of Ukraine according to the list attached.

6. This Resolution shall take effect six months after its publication.

TECHNICAL REGULATIONS
low-voltage electrical equipment


1. This Technical Regulation establishes the requirements for the protection of the health and safety of people and domestic animals and property, to be met by low-voltage electrical equipment (hereinafter - electrical) to provide it in Ukraine. This technical regulations developed on the basis of Directive 2014/35 / EC of the European Parliament and of the Council of 26 February 2014 on the harmonization of the laws of the Member States concerning the provision of market electrical equipment designed for use within certain voltage.

2. These Technical Regulations apply to electrical equipment intended for use for rated voltage of 50 to 1000 V AC and 75 to 1500 VDC, in addition to equipment and phenomena listed in Annex 1.

3. Terms used in this Technical Regulation shall have the following meanings:

issuance - providing electrical in Ukraine for the first time;

retirement - any measure aimed at preventing the provision of electrical equipment on the market, which is in the supply chain of products;

producer - any natural or legal person (resident or non-resident of Ukraine), which manufactures electrical equipment or instructs its development or manufacturing equipment and sells it under its own name or trademark;

withdrawal - any measure aimed at ensuring the return of electrical equipment that has already been provided to the consumer (user);

harmonized European standard - a standard that is adopted by one of the European standardization organizations on the basis of a request made by the European Commission, and the number and name published in the "Official Journal of the European Union";

mark of conformity with technical regulations - marking by which the manufacturer indicates that the electrical equipment meets the requirements applicable to specified electrical equipment and defined in the Technical Regulations, which provides for the application of the labeling;

Importer - any natural or legal person - resident of Ukraine, which enters the circulation market electrics Ukraine originating from another country;

providing market - any paid or free supply of electrical equipment for distribution, consumption or use on the market of Ukraine in the course of economic activity;

conformity assessment - the process of proving that the objectives related to safety, referred to in paragraph 4 of this Technical Regulation and defined in Annex 2 relating to electrical equipment have been fulfilled;

distributor - any other than the manufacturer or importer, natural or legal person in the supply chain of products, which provides electrical in Ukraine;

undertakings - manufacturer, authorized representative, importer and distributor;

technical specification - a document that establishes the technical requirements to be met by electrical equipment;

authorized representative - any natural or legal person - resident of Ukraine which has received written authorization from the manufacturer to act on his behalf in relation to specified tasks in this authorization.

This Technical Regulations the terms "risk","technical regulation" shall have the meaning specified in the Law of Ukraine "On Technical Regulations and Conformity Assessment"; The term "improper use of the mark of conformity with technical regulations" - as defined inthe Law of Ukraine "On State market surveillance and control of non-food products";The term "supply chain products" - as defined in the Law of Ukraine "On General Safety of Non-Food Products"; the terms "international standard" , "national standard" - as defined in the Law of Ukraine "On Standardization".

Providing market and objectives related to safety

4. Electrical equipment may be granted Ukraine market only if, when after manufacture in accordance with proper engineering practices on safety, applied in Ukraine, it is not a threat to the health and safety of people and domestic animals or property, provided proper installation, maintenance and use for its intended purpose.

Free movement

5. Provision of electrical equipment on the market that meets the requirements of these Technical regulations shall not be prohibited or restricted in relation to those aspects covered by this Technical Regulation.

Electricity supply

6. electricity supplier can not set more stringent requirements for electrical safety, than those related to safety, referred to in paragraph 4 of this Technical Regulation and defined in Annex 2 (hereinafter - the objectives related to safety), for accession to the mains or supply of electricity to users of electrical equipment.

Obligations of manufacturers

7. Manufacturers of electrical equipment with the introduction into circulation provided that it be designed and manufactured in accordance with the objectives related to safety.

8. Manufacturers make up the technical documentation referred to in Annex 3, and conduct or instruct the authorized representative of conformity assessment procedures according to Annex 3.

If compliance with electrical objectives related to safety, was brought referred to conformity assessment procedures, manufacturers make a declaration of conformity and put mark of conformity with technical regulations.

9. The manufacturers keep the technical documentation specified in Annex 3, and the declaration of conformity for 10 years after the electrical equipment on the market.

10. Manufacturers ensure the application of the procedures required to maintain compliance of serial production of electrical requirements of the Technical Regulations.Should take into account changes in the design or specifications of products and changes in the national standards referred to inparagraph 34 of the Technical Regulations, international or national standards referred to in paragraphs 35 and 36 of the Technical Regulations or other technical specifications by reference to which the declared conformity of electrical equipment.

If the foregoing is considered appropriate in relation to the risks posed by electrical equipment manufacturers to protect the health and safety of consumers (users) carry out random tests of samples of electrical equipment, given that the market consider appeals of consumers (users) are exploring electric, not meets the requirements of the Technical regulations and cases withdrawal of electrical equipment and the need to keep records on such appeals, improper electrical and revocation cases and inform distributors about the current results of such monitoring.

11. Manufacturers shall ensure that electrical equipment on which they put into circulation, stated type, batch number or serial number or other element that allows it to identify, in cases where the size or nature of the electrical equipment does not allow it to do - that the required information was listed on its packaging or in a document accompanying the electrical equipment is.

12. Manufacturers indicate their name, registered trade name or registered trademarks (for goods and services) and contact email address on electrical equipment, and if this is not possible - on its packaging or in a document accompanying the electrical equipment is.The address must indicate only place where you can be with the manufacturer.Contact details are provided in accordance with the requirements of the law on the procedure for the use of languages.

13. Manufacturers provide electrical maintenance instructions and safety information drawn up in accordance with the requirements of the law on the procedure for the use of languages.These instructions and safety information as well as any labeling shall be clear, understandable and intelligible.

14. Manufacturers who consider or have reason to believe that electrical equipment which they have put into circulation does not correspond to the requirements of the Technical Regulations, immediately take restrictive (corrective) measures necessary to bring such electrical equipment into compliance with those requirements, its withdrawal from circulation and / or revocation (as applicable).If these electrical equipment presents a risk, manufacturers immediately inform the relevant public market surveillance and fed him details, including non-compliance of the electrical requirements of the Technical Regulations and any restrictive measures (corrective) measures.

15. At the reasonable request of the public market surveillance manufacturers provide him with information and documentation (in paper or electronic form) required to demonstrate compliance with electrical requirements of the Technical Regulations.At the request of the body of public market surveillance manufacturers collaborate with him on any measures taken to eliminate risks is entered them into circulation electrical equipment.

Obligations of authorized representatives

16. The manufacturer may on written instructions to identify authorized representative.

The duties set out in paragraph 7 of the Technical Regulations and the duty of drawing up technical documentation set out in paragraph 8 here to, are not included in the subject of orders received by the authorized representative.

17. The authorized representative performs the tasks specified in the order received from the manufacturer.Commission must enable the authorized representative to carry out at least the following duties:

keep the declaration of conformity and technical documentation to assist them on request of public market surveillance for 10 years after the electrical equipment in circulation;

at the reasonable request of the public market surveillance authority to provide such information and documentation necessary to demonstrate compliance with electrical requirements of the Technical Regulations;

at the request of the public market surveillance to collaborate with him on any measures taken to eliminate the risks of electrical equipment, on which subject authorization obtained by the authorized representative.

Obligations of importers

18. Importers injected into circulation only electrical equipment that meets the requirements of the Technical Regulations.

19. Before the introduction into circulation of electrical importers peresvidchuyutsya that the manufacturer had the appropriate conformity assessment procedure and made technical documentation, this electrical affixed mark of conformity with technical regulations, it is accompanied by the required documents and that the manufacturer complied with the requirements set out in paragraphs 11 and 12 of the Technical regulations.

If the importer considers or has reason to believe that electrical equipment does not meet the objectives related to safety, it does not introduce an electrical circulation to bring it in line with these objectives.If these electrical equipment presents a risk, the importer shall inform the manufacturer and the relevant state market surveillance.

20. Importers indicate their name, registered trade name or registered trademarks (for goods and services) and contact email address on electrical equipment, and if this is not possible - on its packaging or in a document accompanying the electrical equipment is.Contact details are provided in accordance with the requirements of the law on the procedure for the use of languages.

21. Importers provide electrical maintenance instructions and safety information drawn up in accordance with the requirements of the law on the procedure for the use of languages.

22. Importers shall ensure that the conditions of storage or transport electrical equipment until it is under their responsibility, not compromise the compliance of its objectives related to safety.

23. In the case where deemed appropriate, given the risks posed by electrical equipment, importers in order to protect the health and safety of consumers (users) carry out random tests of samples of electrical equipment, given that the market consider appeals of consumers (users), examine electrical that does not meet the requirements of the Technical regulations and cases withdrawal of electrical equipment and the need to keep records on such appeals, improper electrical and revocation cases and inform distributors about the current results of such monitoring.

24. Importers who consider or have reason to believe that electrical equipment which they have put into circulation does not correspond to the requirements of the Technical Regulations, immediately take restrictive (corrective) measures necessary to bring such electrical equipment into compliance with those requirements, its withdrawal from circulation and / or revocation (as applicable).If these electrical equipment presents a risk, importers immediately notify the appropriate government market surveillance and fed him details, including non-compliance of the electrical requirements of the Technical Regulations and any restrictive measures (corrective) measures.

25. Importers for 10 years after the electrical equipment in circulation retain a copy of the declaration of conformity to provide it to the needs of public market surveillance and ensure the possibility of such authorities at their request access to technical documentation.

26. At the reasonable request of the public market surveillance importers provide him with information and documentation (in paper or electronic form) required to demonstrate compliance with electrical requirements of the Technical Regulations.At the request of the body of public market surveillance importers working with him on any measures taken to eliminate risks is entered them into circulation electrical equipment.

Obligations of distributors

27. Distributors at time of electrical equipment on the market act with due care in relation to the requirements of the Technical Regulations.

28. Prior to electrical equipment on the market distributors verify that an applied electric mark of conformity with technical regulations, it is accompanied by the necessary documents and instructions and safety information drawn up in accordance with the requirements of the law on the use of languages, and that the manufacturer and importer performed requirements determined in accordance with paragraphs 11 , 12 and 20 of the Technical regulations.

If a distributor considers or has reason to believe that electrical equipment does not meet the objectives related to safety, it does not provide such electrical equipment on the market to bring it in line with objectives.If these electrical equipment presents a risk, the distributor shall inform the manufacturer or importer and relevant state market surveillance.

29. Distributors shall ensure that the conditions of storage or transport electrical equipment until it is under their responsibility, not compromise the compliance of its objectives related to safety.

30. Distributors who consider or have reason to believe that electrical equipment which they have provided the market does not meet the requirements of the Technical Regulations peresvidchuyutsya in taking restrictive (corrective) measures necessary to bring such electrical equipment in accordance with the requirements of its withdrawal circulation and / or revocation (as applicable).If these electrical equipment presents a risk, distributors immediately notify the appropriate government market surveillance and fed him details, including non-compliance of the electrical requirements of the Technical Regulations and any restrictive measures (corrective) measures.

31. At the reasonable request of the public market surveillance distributors provide it with information and documents (in paper or electronic form) required to demonstrate compliance with electrical requirements of the Technical Regulations. At the request of the body of public market surveillance distributors collaborating with him on any measures taken to eliminate risks is provided to the market of electrical equipment.

Cases in which obligations of manufacturers rely on importers and distributors

32. If the importer or distributor of electrical enters into circulation under his own name or trademarks (goods and services) or modify already entered into circulation electrical equipment in such a way that it could affect its compliance with the requirements of this Technical Regulation, it is considered manufacturer for the purposes of this Technical regulation and shall perform the duties of the manufacturer set out in paragraphs 7-15 of the Technical regulations.

Identification entities

33. Entities providing public market surveillance authorities at their request information that enables you to identify:

any entity that put them electrical equipment;

any entity to which they put electrical equipment.

Business entities provide the information specified in this paragraph for 10 years after they were delivered electrical equipment, and 10 years after they set electrical equipment.

The presumption of conformity of electrical equipment

34. The list of national standards that are identical with the harmonized European standards and conformity which provides presumption of conformity with electrical objectives related to safety (hereinafter - the list of national standards), approved and published in accordance with the law.

Compliance electrical standards included in the list of national standards, or parts thereof provides presumption of conformity of this electrical purposes related to safety covered by these standards or their parts.

35. If the national standards referred to in paragraph 34 of the Technical Regulations, was not developed, and their list was not made public, electrical and deemed relevant for the purposes related to safety if it complies with international standards on safety adopted by the International Electrotechnical Commission (IEC) and references to published in the "Official Journal of the European Union."

When posting links to these provisions on the safety of international standards in the "Official Journal of the European Union" to inform the Minister places a list of links to them on its official website.

36. If the national standards referred to in paragraph 34 of the Technical Regulations, was not developed, and their list and list of references to international standards referred to in paragraph 35 of the Technical Regulations not been made public, electrical and deemed relevant for the purposes related to safety if it is made in accordance with national standards for safety in force in Ukraine, and in the case of electrical production in the country - a member of the European Union - national standards in force in that state where it provides level of safety that is equivalent to the level required in Ukraine.

Declaration of Conformity

37. The declaration of conformity is claimed that the objectives related to safety were proven.

38. Declaration of Conformity is in accordance with the structure laid down in Annex 4, containing information specified in Annex 3, and is constantly updated. The declaration of conformity is the official language, and in case when it was drafted in another language - translated into the official language.

39. In the case when the electrical covered several technical regulations that require taking the declaration of conformity is the only declaration of conformity for all of these technical regulations. In this declaration of conformity shall include relevant technical regulations, including information on their official publication.

The only declaration of conformity can take the form of a dossier consisting of the respective individual declarations of conformity.

40. The manufacturer by making a declaration of conformity takes responsibility for the conformity of electrical equipment to the requirements of this Technical Regulation.

General principles of CE conformity with technical regulations

41. The mark of conformity with technical regulations applied in accordance with the general principles specified marking sign the law.

Terms and conditions applying mark of conformity with technical regulations

42. The mark of conformity with technical regulations applied to electric or on its plate with the technical data so that it was visible, legible and indelible. In the case where it is impossible or unreasonable due to the nature of electrical mark of conformity with technical regulations applied to the packaging and to the accompanying documents.

43. The mark of conformity with technical regulations applied to the electrical input into circulation.

44. restrictive (corrective) measures in case of improper use of the mark of conformity with technical regulations used in accordance with the law.

State Market Surveillance and State Control Electrical

45. State Market Surveillance and State Control pursuant to law to meet the requirements of the Technical Regulations.

46. ​​Measures to eliminate formal discrepancies are used in cases where public authority market surveillance establish any such discrepancy:

mark of conformity with technical regulations was applied in violation of the general principles of the said mark marking required by law or the requirements of paragraphs 42-44 of this Technical Regulation;

was not applied mark of conformity with technical regulations;

was not drawn up a declaration of conformity;

a declaration of compliance was drafted in violation of;

market surveillance of the public do not have access to technical documentation, or it is incomplete;

information as defined in paragraphs 12 or 20 of these Technical Regulations absent is false or incomplete;

not done any other of the administrative requirements set out in paragraphs 7-15 or 18-26 of this Technical Regulation.

KEY ELEMENTS
purposes related to safety for low-voltage electrical equipment

1. General requirements:

1) information about the essential characteristics, knowledge and observance of which ensure the safe use of low-voltage electrical equipment (hereinafter - electric) and use it appropriately, applied to the electrical equipment, and if this is not possible, - the accompanying document;

2) electrical equipment, together with its component parts are made so as to ensure its safe and proper preparation and accession;

3) electrical equipment is designed and manufactured in a way that provides a guarantee of protection against hazards identified in paragraphs 2 and 3 of this Annex, provided that such equipment is used for its intended purpose and properly maintained.

2. Protection against hazards that may arise from the use of electrical equipment

According to paragraph 1 of this annex defined technical measures to ensure that:

adequately protect people and pets against the risk of physical injury or other damage that might be caused by direct or indirect electrical contact;

inability formation temperatures, electric arcs or radiation which would cause a danger;

adequate protection of people, domestic animals and property from the dangers of non-electrical nature, which, as experience shows, are caused by electrical equipment;

suitability for isolation foreseeable conditions.

3. Protection against hazards which may arise due to the influence of external factors on electrical equipment

According to paragraph 1 of this annex defined technical measures to ensure that electrical equipment:

consistent with the expected mechanical requirements in such a way that people, domestic animals and property are not exposed to danger;

were resistant to non-mechanical influences in expected environmental conditions so that people, domestic animals and property are not exposed to danger;

Module A
(internal production control)

1. Internal production control is the conformity assessment procedure whereby the manufacturer fulfills the obligations laid down in paragraphs 2-4 of this Annex, and ensures and declares under sole responsibility that the appropriate voltage electric equipment (hereinafter - electric) satisfies the requirements of the Technical regulation of low voltage electrical equipment (hereinafter - the Technical regulation) that apply to the specified electrical equipment.

Technical documents

2. The manufacturer develops technical documentation. Technical documentation must enable the appropriate electrical assess compliance requirements and should include appropriate analysis and risk assessment (risks). Technical documentation shall include requirements that apply and are covered as far as it concerns such an assessment, the design, manufacture and operation of electrical equipment. The technical documentation shall, where appropriate, contain at least the following elements:

general description of the electrical equipment;

conceptual design, manufacturing drawings and schemes of components, assemblies, circuits, etc;

descriptions and explanations necessary for understanding these drawings and diagrams and the operation of electrical equipment;

a list of the standards applied in full or in part, of the list of national standards, compliance with which provides presumption of conformity with electrical objectives related to safety or the list of international standards and national standards referred to in paragraphs 35 and 36 of the Technical Regulations. If the specified standards on the list of national standards, international standards or national standards have not been applied, are descriptions of the decisions taken in order to meet the objectives related to safety, as defined in the Technical Regulations, including a list of other relevant technical specifications that were used. In case of partial use of the list of national standards or international standards or national standards referred to in paragraphs 35 and 36 of the Technical Regulations specified in the technical documentation of parts which have been applied;

results of the design calculations conducted research etc.

Production

3. The manufacturer shall take all measures necessary to ensure that the manufacturing process and its monitoring ensure conformity of manufactured electrical technical documentation referred to in paragraph 2 of this application and the requirements of the Technical Regulations applicable to specified electrical equipment.

Marking of conformity with technical regulations and declaration of conformity

4. Producer shall mark of conformity with technical regulations for each separate unit of electrical equipment that satisfies the requirements of the Technical Regulations applicable to specified electrical equipment.

Manufacturer makes written declaration of conformity for a product model and keep it together with the technical documentation for grant requests of public market surveillance for 10 years after the electrical equipment on the market. The declaration of conformity must be identified electrical equipment for which it was composed.

A copy of the declaration of conformity provided the relevant state market surveillance on their requests.

Authorized representative

5. Responsibilities of the manufacturer set out in paragraph 4 of this Annex, on his behalf and under its responsibility can be fulfilled by his authorized representative provided the following definition of responsibilities in order.
