On July 1, 2018, the decision of the ECE Collegium on Registration of Declarations of Conformity of the EAC of March 20, 2018 No. 41 "On the Procedure for Registration, Suspension, Renewal and Termination of Declarations Conforming to the Requirements of the Technical Regulations of the Eurasian Economic Union"

Which documents become invalid?

The previous decision form April 9, 2013 N 76 dismissed ( previous rules of applying and registering declarations of Conformity EAC), however, all the declarations registered before the entry into force of Decision N41 remain valid until the expiration of their validity. At the same time, the legal act N76 of February 21, 2012 continues to operate.

 

Registration of a new declaration without submission of documents and information

First and foremost it is worth noting that the established new provisions that make it possible to receive and register new declaration without providing the documents and information provided by subparagraphs "b" - "d" of paragraph 5 of the new order in the following cases:

• In the declaration and its annex, errors or misprints were revealed;
• the legal form or requisites of the applicant have changed;
• the organizational and legal form or details of the manufacturer of the products have changed;
• the number of addresses of places where production activities were carried out has decreased.

However, if only the phone number and / or e-mail address are changed, as well as the TNEA foreign economic activity codes, the declaration and applications are not required to be replaced, although it can be carried out at the request of the applicant. It is important to understand! When accepting and registering a new declaration, it is recommended to terminate previously registered declarations using the electronic registration service. This is indicated in paragraph 15 of the new Order. Changes in the package of documents

Decision N41 establishes a number of new requirements for the documentation required to register the declaration. Among which it is important to note the following:

• It is necessary to provide copies of evidence supporting the submission of technical regulations. All of them must be certified with the seal and signature of the applicant.
• The above copies must be entered in the national part of the Unified Register of issued certificates of conformity and registered declarations of conformity.
